Terms and Conditions for SMPCA's Scalp Micropigmentation Training Course

The Terms and Conditions of Use (the “Terms of Use”) constitute an agreement between you (“you”, “yours”, or "User") and Scalp Micropigmentation ("SMPCA" or "we" or "us"), governing your participation in the SMP Training Course ("Course"). By accessing the Course, you agree to be bound by the terms and conditions set forth herein.Â
Please review these Terms of Use carefully.
1. Intellectual Property Protection:
1.1 Ownership: All intellectual property rights in the Course, including but not limited to training materials, manuals, videos, and any proprietary techniques or methodologies, are the exclusive property of SMPCA.
1.2 Restrictions: You agree not to reproduce, distribute, disclose, modify, reverse engineer, or create derivative works based on any course content without the expressed written consent of SMPCA. Any violations of the restrictions stated above may lead to early termination of your access to the Course.
1.3 Confidentiality: You acknowledge that all training materials and information provided during the Course are confidential and proprietary to SMPCA. You agree to keep such information confidential and not disclose it to any third party.
2. Governing Law:
2.1 Jurisdiction: This Agreement and any disputes or claims arising out of or in connection with it or its subject matter shall be governed by and construed in accordance with the laws of the state of California, excluding its conflicts of law principles.
2.2 Venue: Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located within Alameda County, San Lorenzo, California. By enrolling in the Course, you consent to the jurisdiction of such courts and waive any objection to the laying of venue in any such court.
2.3 Consistency: This Governing Law Clause is intended to be consistent with the laws of the state of California, Alameda County, San Lorenzo. In the event of any conflict between the laws of California and this Clause, the laws of California shall prevail.
3. Responsibilities as a User:
3.1 Compliance: You are responsible for complying with all applicable laws and regulations related to scalp micropigmentation practices.
3.2 User Registration: Your login information (email, username, or password) are for your personal use only and should be kept confidential.
4. Liability Protection for SMPCA:
4.1 Limitation of Liability: SMPCA shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the Course, including but not limited to any injuries, losses, or damages incurred during practical training sessions.
5. Fees:
5.1 Tuition Fees: The fees for the Scalp Micropigmentation Training Course are as specified on the SMPCA website or provided to you during the enrollment process.
5.2 Modification of Fees: SMPCA reserves the right to modify Course fees at any time. Any fee changes will not affect participants already enrolled in the Course but will apply to future enrollments.
6. Refund Policy:
6.1. Non-refundable: No refunds will be granted for any reason. An early termination, whether by SMPCA or by user, will be no exception.
7. Termination:
7.1 Termination by SMPCA: SMPCA reserves the right to terminate your participation in the Course at any time, with or without cause, without liability to SMPCA.
7.2 Termination by Participant: If you wish to terminate your participation in the Course, you may do so by prompting a deactivation of your account. No refunds will be provided for terminated participation.
8. Miscellaneous
1 Corrections: In the case where information on the Course contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, Course data, and various other information, SMPCA reserves the right to correct any errors, inaccuracies, or omissions and to change or update the information to the Course at any time, without prior notice.
By enrolling in the Scalp Micropigmentation Training Course, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree, it is highly recommended you do NOT enroll in the Course.
SMPCA reserves the right to update or modify these Terms of Use at any time, with such changes being effective upon posting. It is your responsibility to review the Terms of Use periodically for updates.
